01 Prerequisite: Confirm the jurisdiction of domestic courts
The first prerequisite for handling an overseas uncontested divorce is to confirm that the domestic court has jurisdiction over the divorce case, and it can be accepted according to law if any of the following conditions are met:
- One party still holds Chinese nationality;
- The other party has a legal residence or habitual residence in China;
- The original place of marriage registration of both parties was in China.

This link is the final core link in the divorce process. It is completed online and the parties do not need to return to the country. The specific process is as follows:
(1) The court will notify the specific time, trial platform and operating procedures of the online trial in advance. The entrusted lawyer will assist the parties to debug the equipment (mobile phones and computers are acceptable), guide the parties to prepare for the trial, and ensure that the trial proceeds smoothly. (2) During the court hearing, the parties involved must go online on time and cooperate with the judge to verify their identity information, clarify their divorce intentions, and confirm that both parties have no disputes about property division, child support, and other related matters. If they choose to confirm the authorization online, they must make a clear statement to the judge in court to confirm the authenticity of the power of attorney and the intention to voluntarily entrust it. The trial process of uncontested divorce cases is simple and efficient, and all aspects of the trial are completed. (3) After the court hearing, the judge will issue a divorce mediation document or judgment in accordance with the law. 03 Practical Tips
(1) Notarization of materials is a core link. It is necessary to communicate with the competent court in advance to clarify the court’s specific requirements for notarization materials (such as notarization agency, notarization content, etc.), so as to avoid rejection of materials due to non-compliance with standards in notarization and delay in the processing cycle.
(2) The authorization method needs to be selected based on the specific caliber of the jurisdictional court. Different courts have different requirements for "online confirmation after express delivery" and "notarization confirmation". It is recommended to communicate with the filing division of the court in advance for confirmation, and then choose the corresponding method based on your own needs (convenience or compliance and stability) to avoid procedural risks.
